The purpose of a stay of execution pending appeal is not to enable the applicant to prosecute an appeal in circumstances where they will or may not be able to pay the other party's costs if the appeal is unsuccessful. An applicant with sufficient equity to pay both the respondent's costs and their own appeal costs will not obtain a stay of a costs order merely because payment would reduce their capacity to fund the appeal.
