Documents recording a party's instructions to their solicitors regarding a contractual letter are irrelevant to the construction of that letter because contract construction is objective. Notices to produce served on appeal for the purpose of speculative evidence-gathering are an abuse of process, and proof of ulterior purpose is not required where the documents are plainly irrelevant to the appeal.
