A judicial valuer in compulsory acquisition proceedings is not bound to give weight to a non-binding offer to purchase merely because the offer is accepted as a relevant consideration; the weight to be given is a question of fact. A party bearing the burden of proving a higher market value cannot establish error of law by asserting 'no evidence' justified the court's failure to accept their claim. A judicial valuer is not obliged to adopt expert evidence on a development consent premium even where it is the only expert evidence on the point.
