The Court of Appeal granted leave to the appellant to withdraw his appeal against a contempt conviction, with the consequence that the 18-month imprisonment term imposed by Pembroke J ran from the date of the original order (27 July 2012) under s 47(1) of the Crimes (Sentencing Procedure) Act 1999, not from the date of actual apprehension (27 January 2013). The Court noted that unlike the Court of Criminal Appeal under s 14A(4) of the Criminal Appeal Act 1912, the Court of Appeal lacks a statutory mechanism to adjust the commencement date of a sentence in these circumstances, and called for legislative reform to address this gap.
