The removal or demolition of an existing dividing fence does not constitute 'fencing work' under the Dividing Fences Act 1991 (NSW), and neither the Local Court nor a local land board has jurisdiction to order the removal of a sufficient dividing fence. An adjoining owner who objects to a fence erected by the other owner on that owner's own land has no remedy under the Act; any remedy lies in trespass or other common law causes of action. A letter objecting to proposed fencing that does not seek contribution and does not comply with s 11(2) requirements is not a valid notice under s 11.
