Section 60(5) of the Workers Compensation Act 1987 (NSW) requires mandatory referral to an Approved Medical Specialist of all disputes concerning proposed treatment, including where the only issue is factual causation. The referral requirement cannot be bypassed by characterising the dispute as one of causation rather than one about the proposed treatment itself. The regulation-making power in s 60(5) provides the mechanism for displacing the mandatory referral requirement if problems of delay arise.
