Where a cross-appeal application and an existing appeal involve overlapping issues, the efficient use of judicial resources under ss 56-58 of the Civil Procedure Act 2005 (NSW) favours a concurrent hearing, and the risk of modest irrecoverable additional costs to a party subject to statutory costs restrictions does not outweigh that consideration.
