Where the trial judge's assessment of damages falls below $100,000, an appeal from the District Court is incompetent under s 127(2)(c) of the District Court Act 1973 (NSW) unless leave to appeal is granted. An application for leave to appeal that is substantially out of time, non-compliant with procedural requirements, and discloses no arguable ground of appeal will be struck out.
