A sentencing judge may find that offences caused some psychological harm to a victim without medical evidence, but cannot make a quantitative or qualitative assessment (such as 'substantial' or 'significant') of the extent of that harm without expert evidence, particularly where the victim's psychological damage has multifactorial causes. Mixed verdicts on a multi-count sexual offence indictment are not unreasonable where the counts on which the jury convicted were supported by independent corroborative evidence (such as contemporaneous records and complaints) that was lacking for the counts on which the jury acquitted.
