The offence of aggravated people smuggling under s 233C of the Migration Act requires proof that the accused intended to facilitate the bringing of persons to Australia. The mention of a particular destination within Australia (such as Ashmore Reef) in the evidence does not create an additional element requiring proof that the accused knew that specific place was part of Australia. A direction about knowledge that a specific location is part of Australia is only necessary where the evidence is confined to awareness of a specific destination and does not otherwise establish knowledge that the ultimate destination was Australia.
