There is no authority supporting the proposition that digital sexual intercourse is, of itself, less serious than other forms of forced sexual intercourse; objective seriousness must be determined by reference to the entirety of the facts and circumstances, and it is erroneous to rank forms of forced sexual intercourse in a hierarchy. A Muldrock error in sentencing for counts subsumed by a concurrent sentence on another count (where no error exists) may still be material if it has the capacity to infect the overall sentencing discretion, but will not result in a lesser sentence being warranted where the overall sentence is within range.
