Conceded Muldrock error does not automatically result in resentencing; the Court will refuse an extension of time to appeal where, upon re-exercising the sentencing discretion, no lesser sentence is warranted in law under s 6(3) Criminal Appeal Act 1912. An attack on a sex worker who is vulnerable as a result of attending a private dwelling at the request of the offender constitutes a crime of very considerable gravity. Leaving an injured victim without assistance at the scene may properly be regarded as a circumstance of aggravation.
