The Abdul framework for extension of time applications (considering delay, explanation, community interests, victim interests, and substantial injustice) applies to all criminal appeals, not only those based on Muldrock error. Where an extension of time is sought, the applicant bears an onus to adduce evidence fully explaining the delay, including a clear articulation of steps taken and comprehensive explanation for periods of inactivity. The merits examination in such applications may be conducted in a more summary fashion than on a full appeal.
