Clause 4.2A(4)(a) of the Wollondilly LEP 2011 (and by analogy, similar provisions in other LEPs) is a development standard applicable only to development already permitted under the Land Use Table; it does not create an independent power to grant consent to development that is prohibited under the Land Use Table. However, a replacement dwelling house under cl 4.2A(4)(a) is not limited to replicating the existing elements of the original dwelling and may include modern facilities not present in the original structure.
