The two-stage test from Singer v Berghouse (No 2) continues to apply to family provision claims under s 59 of the Succession Act 2006 (NSW), notwithstanding the different view expressed by Basten JA in Andrew v Andrew. An adult child's permanent disability and inability to work, combined with reliance on a spouse's diminishing earning capacity, may render a 17% share of an estate inadequate even where the deceased had reasons for the unequal distribution. The court will not disturb provision for a sibling who devoted her adult life to caring for the deceased.
