Section 100(1) of the Residential Tenancies Act (NT) confers a discretion on the court to decline to terminate a tenancy even where the threshold grounds (illegal use, repeated nuisance, or repeated interference with peace/privacy) are established. The court must consider whether termination is appropriate in the circumstances before making orders. Section 105 (suspension of possession for severe hardship) operates independently and does not displace the s 100(1) discretion.
