Where a question has been raised about whether a party has complied with an order for further and better particulars, the court should not immediately exercise the power under r 374 UCPR to enter judgment but should instead adjourn to allow the party to file evidence establishing compliance. Where a primary judge gives no reasons, appellate error can only be inferred from the result under House v The King.
