A sentence of nine years imprisonment for manslaughter under s 8 of the Criminal Code was upheld where the offender lured the deceased to his killers knowing of their intention to inflict serious harm with death a probable consequence, and where the offender had cooperated with police and pleaded guilty. An aider or abettor under s 8 is not invariably less culpable than the principal offender and may receive a comparable or higher sentence depending on the circumstances. The discount for s 13A cooperation must be discernible and worthwhile but the adjusted sentence must still reflect the seriousness of the offence.
