Where a prisoner commits an offence during the period of a parole order and is subsequently sentenced after the parole period has expired, the parole order is automatically cancelled under s 209 of the Corrective Services Act 2006 (Qld), and s 215 (which deems the period of imprisonment served upon expiry of the parole order) does not apply. In that situation, only the time on parole up to the commission of the offence counts as time served. Where consecutive terms of imprisonment are ordered to run from the end of a previous sentence, they constitute a single 'period of imprisonment' under s 4 of the Penalties and Sentences Act 1992 (Qld), and s 160B(2) requires the court to fix a parole eligibility date rather than a parole release date.
