Where the Legal Practitioners Admissions Board is unable to resolve conflicting medical evidence regarding an applicant's suitability for admission, the appropriate course is to refer the application to QCAT under s 32(3)(b) for a direction rather than simply refusing to make the declaration. The Court of Appeal has power under s 33(3) to make any order it considers appropriate on appeal, including orders the Board could have made, even without finding error on the Board's part. A defective information notice that omits appeal information does not render the decision a nullity where the applicant suffers no prejudice.
