In sentencing for electronic communication offences exposing children to indecent matter, the involvement of a real child (as opposed to a police officer) justifies a higher head sentence than comparable cases, but the parole eligibility date or suspension point must still be proportionate to comparable sentences. Where comparable cases show a pattern of suspension earlier than the standard one-third point, departing from that pattern requires justification. Probation with a condition of psychiatric or psychological treatment may be appropriate where prison-based treatment programs cannot be assured.
