Where a plaintiff has a significant pre-existing condition managed with narcotic medication and a patchy employment history, a trial judge is entitled to use the closure of the defendant's worksite as a sensible device for measuring the chance of continuing employment, and to apply a discount reflecting both the Malec approach and vicissitudes of life without this constituting impermissible double discounting. The assessment of damages for personal injuries has many characteristics of a discretionary judgment and an appellate court will not intervene merely because another judge might have awarded a different amount.
