An express trust over funds in a bank account can be established by inference from the settlor's statements and conduct, including naming the account as a 'Building Account', arranging for a third party to be a cheque signatory, and making consistent statements to multiple persons about the purpose of the funds. A settlor's subsequent change of mind after creation of the trust does not vitiate the trust. Self-appointment as trustee may be justified in exceptional circumstances where a beneficiary's claims threaten to exclude other beneficiaries from the trust.
