Apprehended bias of a nominating authority in selecting an adjudicator vitiates the adjudication determination, and a Chinese wall arrangement within the nominating authority is insufficient to cure the apprehension. An adjudicator who determines a payment claim on a legal basis (such as the prevention principle) not raised by the parties must afford the parties an opportunity to make submissions on that basis, failing which the determination is void for denial of natural justice. A payment claim under s 13(2) of the SA Act may be calculated on a cumulative basis and is not invalidated by arithmetical errors or redundancies provided it is sufficiently comprehensible.
