For offences under s 33(1) of the Controlled Substances Act 1984 (SA), the prosecution need not prove that the accused knew or was reckless as to the quantity of the controlled drug being manufactured; s 33P confines the required mental element to knowledge or recklessness as to the identity of the substance. The notification requirement in s 47(a) of the Telecommunications (Interception and Access) Act 1979 (Cth) is satisfied by informing the carrier of the issue of the warrant under s 60(1)(c); the separate requirement to provide a certified copy under s 60(1)(d) is not a precondition to lawful interception. For large-scale methylamphetamine manufacturing by a principal offender with prior drug convictions, the sentencing range is approximately 15 to 20 years' imprisonment.
