Fresh medical evidence establishing a mental condition at the time of offending, which was not and could not have been before the sentencing judge, may warrant admission on appeal and resentencing where the condition explains otherwise inexplicable offending behaviour. Where an offender's mental impairment is causally related to the offending, general deterrence should be given lesser weight and suspension of sentence may be appropriate even for serious offending.
