Where a young offender's course of conduct gives rise to charges in both the Youth Court and the District Court, the offender should be sentenced in one court for all offences to enable proper consideration of totality. A recidivist young offender declaration under s 20C(3) of the Criminal Law (Sentencing) Act 1988 (SA) that is made after the conviction for the relevant offence does not bind the sentencing court to fix a non-parole period of at least four-fifths of the head sentence. The combined effect of sentences imposed by two courts on a young offender may be set aside as crushing even where neither individual sentence is manifestly excessive in isolation.
