A representative action under 6SCR 81 is commenced for limitation purposes when the plaintiff files the originating process, not when the Court grants the authorisation order. Group members need not themselves commence an action within the limitation period; the plaintiff's filing of the summons as a representative action satisfies s 35(c) of the Limitation of Actions Act 1936 (SA) for the entire group. The Court's power under 6SCR 81(5)(a) to define the group is not limited by the group identified in the summons or statement of claim.
