The Environment, Resources and Development Court has power under section 88(1) of the Development Act 1993 (SA) to set aside a development authorisation as a consequential order upon finding that the categorisation decision under section 38 was erroneous. The jurisdiction to review a categorisation decision under section 86(1)(f) does not cease upon the grant of final development authorisation. Adjacent owners who were deprived of notice by an erroneous Category 1 categorisation may seek review and consequential relief even after development authorisation has been granted.
