On an application under r 54.02 for judicial advice authorising executors to sell estate assets, the court is not required to investigate disputed questions about the history of estate administration, including whether solicitors' costs were properly incurred. Such complaints about maladministration by executors are outside the scope of the summary judicial advice procedure and must be investigated in another forum. A party who elects to proceed after a procedural ruling excluding late-filed evidence, without seeking an adjournment, cannot subsequently complain about the exclusion of that evidence.
