A non-associated third party payer under the Legal Profession Act 2004 (Vic) may enter into a binding agreement compromising its statutory right to a costs review under Division 7 of Part 3.4. Section 3.4.48A does not, by implication, preclude such contracting out. A settlement agreement providing for an undifferentiated lump sum contribution to legal and advisory costs can constitute an accord and satisfaction that conclusively resolves the costs issue and precludes a later costs review application.
