Common law loss of chance principles cannot be applied to discount equitable relief in proprietary estoppel cases; the relief is moulded around the expectations engendered by the estopped party's promises, not calculated by reference to the probability of a hypothetical outcome. Where promises to provide for family members from an estate induce the promisees not to seek provision under family provision legislation, proprietary estoppel may be established even though the promises lack the specificity required for an enforceable contract. Relief may be moulded by reference to the provision the promisees would have obtained under the family provision legislation.
