A sentencing judge is not bound to sentence within the prosecution's suggested range and is not required to indicate an intention to depart from that range before doing so. The ground of manifest excess is not an occasion to re-argue the plea in mitigation. In stalking cases, a short duration of stalking does not preclude a significant sentence where the nature of the threats and their lasting psychological impact on the victim are severe.
