A clause in a memorandum of common provisions providing for service of notices at the mortgagor's address shown in the mortgage, at a new address notified in writing, at the registered office, or in any manner provided by statute, is facultative: each sub-clause provides an independent basis for service, and notification of a new address does not supplant the address in the mortgage. The construction of s 113 of the Transfer of Land Act 1958 (Vic) as to service by leaving a document at the address shown in the mortgage was left open.
