Where the risk of reoffending is assessed as low, s 6D(a) of the Sentencing Act 1991 (Vic) requiring protection of the community as the principal sentencing purpose should have at most minimal impact on sentence. A significant disparity between sentences on charges of similar gravity requires explanation, and the representative nature of a charge does not justify a disproportionate sentence where culpability is reduced and rehabilitation prospects are good.
