An adjudicator's determination of whether a response was served within the 14-day time limit under s 27(1) of the Construction Contracts Act 2004 (WA) is a decision within jurisdiction, and an erroneous determination on that question does not constitute jurisdictional error amenable to certiorari. An adjudicator is not obliged to consider a response served after the 14-day period, though may have a discretion to do so in appropriate circumstances. The correction of an omitted payment date under s 41(2) is permissible as an accidental slip or omission.
