In stay applications concerning working with children negative notices, the public interest in child protection is a significant factor favouring the grant of a stay where the appeal has reasonable prospects of success, because if the appeal succeeds, the respondent may have been working with children on the basis of an erroneous order. The question of whether the Hardingham approach to non-conviction charges is consistent with Grindrod was left open for determination on appeal.
