An exculpatory statement made by an accused approximately four and a half minutes after the relevant event, in response to a police officer's comment rather than spontaneously, does not form part of the res gestae where the accused had time to collect his thoughts and the possibility of concoction cannot be excluded, notwithstanding that the accused was in considerable pain at the time.
