The principles governing stay of possession orders pending appeal require the applicant to demonstrate reasonable prospects of success on appeal and that the balance of convenience favours a stay. Bare assertions of fraud, unconscionability, or lack of standing without proper particularity are insufficient. A financing statement filed under the Uniform Commercial Code does not deprive an Australian bank of standing to enforce a mortgage.
