The seriousness of an offence under s 445A read with s 444A of the Criminal Code (WA) is to be assessed by reference to: the nature and extent of the offender's criminal negligence, the nature of the property destroyed or damaged, and the extent of the destruction or damage. General deterrence is an important sentencing consideration for fire negligence offences because the consequences of such negligence can be calamitous and fires are unpredictable. A sentence of 8 months' immediate detention for a juvenile with no prior record was upheld where the fire destroyed a primary school causing $16-20 million damage, notwithstanding substantial mitigating factors.
