For dangerous driving occasioning death under s 59(1)(b) of the Road Traffic Act 1974 (WA) where the offence is not committed in circumstances of aggravation, a sentence of 5 years' imprisonment (50% of the 10-year maximum) was held manifestly excessive where the offending, though very serious, was not in the upper range of seriousness, the offender pleaded guilty on the fast-track system (warranting a discount of not less than 25%), had no prior criminal record, and had significant personal mitigating circumstances. A sentence of 3 years 6 months was substituted. A total effective sentence of 6 years for multiple dangerous driving offences arising from a single course of conduct infringed the totality principle; 4 years 6 months was substituted.
