A minimum non-parole period of 13 years for murder under s 279(1)(b) of the Criminal Code (WA) — where the offender intended to cause bodily injury that was objectively life-threatening but did not intend to kill, acted without premeditation, but had a significant history of violence and high risk of reoffending — is at the lower end of the statutory range and is not manifestly excessive. Oral sentencing remarks should be read as a whole with due allowance for infelicities of expression.
