When conducting a de novo review of a negative notice decision under the Working with Children (Criminal Record Checking) Act 2004 (WA), the Tribunal must independently evaluate all underlying information and material to assess unacceptable risk, and must not treat the outcome of a criminal trial acquittal or departmental inquiry as determinative of the probative value of that material. A verdict of not guilty does not establish that the jury disbelieved the complainants; it establishes only that the jury was not satisfied beyond reasonable doubt. The term 'reasonable suspicions' in the Grindrod [No 2] framework connotes a reasonable apprehension of matters for which there is insufficient warrant to make a positive finding of fact, and does not bear a technical criminal law meaning.
