An intentional failure to provide personal details when lawfully required to do so by a police officer constitutes a 'refusal' for the purposes of s 53 of the Road Traffic Act 1974 (WA). Only the court that entered a conviction in a party's absence has power under s 73 of the Criminal Procedure Act 2004 (WA) to set aside that conviction on its own initiative.
