For the federal offence of importing child pornography contrary to s 233BAB(5) of the Customs Act 1901 (Cth), immediate imprisonment is ordinarily the only appropriate sentence, and general deterrence is the paramount sentencing consideration. Where an offender is reckless as to the content of imported child pornography, the increase in culpability from actual knowledge over recklessness is at the margins, and sentencing only on the basis of what the offender actually knew would fail to incorporate responsibility for recklessly importing the material. A recognisance release order directing immediate release was manifestly inadequate where the material was at high levels of depravity and significant duration.
