A modified Edwards direction regarding post-offence flight conduct is not required where the flight evidence is not an indispensable link in the chain of proof, the accused has given a specific innocent explanation, and the trial judge has adequately directed the jury that circumstantial evidence alone cannot establish guilt. Where the defence has advanced a specific explanation for flight, it may be inappropriate for the trial judge to suggest other exculpatory reasons, as this could undermine the defence case. A Ciantar direction regarding consciousness of guilt of a lesser alternative offence is not required where the physical element of the primary and alternative offences is identical and the post-offence conduct, viewed with all the evidence, is not neutral between the offences.
