Voluntary disclosure of offences that would otherwise have remained undetected is a significant mitigating factor that can be decisive in reducing an aggregate sentence on totality grounds, even where the offending is serious and the offender has an extensive criminal record. Where an offender is to be sentenced for offences across jurisdictions, the Magistrates Court offences should be dealt with in the District Court under s 32 of the Sentencing Act 1995 (WA) to avoid fragmented sentencing that risks infringing the totality principle. Non-compliance with s 8(4) of the Sentencing Act 1995 (WA) does not constitute an appealable error.
