A discount of 4% under s 9AA of the Sentencing Act 1995 (WA) for a very late guilty plea entered five days before a second trial is within the range of a sound exercise of the sentencing discretion, particularly where the victims had twice prepared for trial and the basis for the late plea (claimed lack of recollection due to self-induced intoxication) was not a weighty factor. An aggregate sentence of 7 years 6 months for separate and distinct offending involving aggravated home burglary, aggravated armed robbery, motor vehicle theft, causing bodily harm and reckless driving does not infringe the first limb of the totality principle where the offender has an extensive prior criminal record.
