An appellant who discontinues an appeal because the underlying proceedings have been determined (rendering the appeal futile) will not be relieved of the default obligation under r 59(4) to pay the respondent's costs. Changes to trial dates that do not affect the substance of the appeal do not constitute a reason to depart from the default costs order.
