A sentence of 5 years' imprisonment for deliberately driving a motor vehicle at an estranged spouse causing grievous bodily harm with intent is within the appropriate range for offences under s 294(1) of the Criminal Code (WA). Hardship to an offender's children resulting from incarceration does not warrant suspension of an otherwise appropriate sentence where the offender is morally responsible for the circumstances giving rise to the hardship and adequate alternative care arrangements are in place.
